A key role in the administration of Funds in Court [FIC] is ensuring that all payments into and out of Court comply with relevant legislation, rules and orders.

FIC has Legal Services who provide legal advice and make recommendations to the Senior Master and staff of FIC.

Other primary responsibilities of Legal Services include:

  • preparation and interpretation of orders of the Court
  • supervising all payments out of Court
  • supervising the preparation of all FIC precedents
  • approving all Declarations of Trust
  • assessing all legal costs payable by clients.

Legal Services also handles matters that deal with the rights of clients, such as:

  • dealing with letters of demand
  • providing assistance with some legal matters relating to Family Law, Social Security and matters at the Victorian Civil and Administrative Tribunal (VCAT)
  • issues with Centrelink or the Transport Accident Commission (TAC).
