A person may be able to claim compensation if they have suffered physical, psychological or financial harm as a result of negligent medical treatment.
Medical negligence occurs when a health professional or health service provider fails to meet their common law duty to provide ‘reasonable care’ to a patient. For example, there has been a failure to diagnose, or act upon, a medical condition, or an injury was caused during an operation.
Compensation paid for medical negligence may include:
- general damages for pain and suffering
- the cost of medical expenses and treatment arising from your injury
- loss of earnings
- in some cases, you may be able to receive compensation for past care and attention.
Clients of the Court who have received funds because of a medical negligence case will receive assistance from the staff at Funds in Court [FIC] in regards to:
- modifying a house or car
- receiving further medical treatment or attendant care
- accessing legal advice.
