If the Senior Master is managing your funds in Court, you need to make an application every time you want to access your money.
Funds may be used for any reasonable, affordable and constructive purpose. Funds are always subject to the direction of the Senior Master, which means that only a Judicial Officer can make an Order of the Court that allows funds to be paid out for a particular purpose.
A Judicial Officer will consider the following for every request:
- How will the expenditure benefit the client?
- Can their funds in Court afford to pay for the request?
- Are there ongoing costs that need to be considered?
- How will the interests of the client be protected?
You can make an application by contacting FIC and talking to your Client Services Officer. You can contact us by:
Phone: 1300 039 390 (+61 3 9032 3777 if you are outside Australia)
Email: requests@fundsincourt.vic.gov.au
Post: Funds in Court, Supreme Court of Victoria, 210 William Street, Melbourne VIC 3000
Fax: 1300 039 388.
Your Client Services Officer can help you complete your application if you are not sure what you need to do. Your application needs to include:
- a description of the item
- a summary of why it is the best option for you
- a quote which shows the final price.
When your Client Services Officer is satisfied with your application, they will send it to the Senior Master. Only the Senior Master can approve the application.
The Senior Master will consider whether:
- the purchase will benefit you
- your funds in Court can afford to pay for the request
- your long term interests are protected.
If the Senior Master approves your application, a payment is authorised by Court order. Your Client Services Officer will arrange the payment.
If your application is not approved, you should talk to your Client Services Officer about your options.
