What does ‘until further order’ mean?

Normally, funds are paid into Court because of a court order. If the order says that your funds are to be held ‘until further order’, your money will stay with Funds in Court until there is a Court order saying otherwise.

How do you apply to have all your funds paid out to you?

If your funds are held until further order, you need a Court order saying all your funds can be paid out to you. To get this Court order, you need to:

  • be over 18 years old
  • show that you will be able to manage the lump sum of money by yourself.

Follow the steps below to apply to get your funds paid out to you.

Step 1: Talk to us

Talk to your Client Services Officer or Client Liaison Officer at Funds in Court. Let them know you want to apply to get all your funds paid out to you. They will tell you what to do next.

Step 2: Talk to a Client Liaison Officer

We may ask you to meet with one of our Client Liaison Officers. They will talk with you about your application and your circumstances in more detail. They may visit your house to talk to you.

Not every client will need to do this.

Step 3: Talk to an expert

We may ask you to meet with an expert, like a medical professional or a financial counsellor. We can help you organise the appointment if needed.

Your funds in Court may be used to pay for the appointment if needed.

Not every client will need to do this.

Step 4: The Senior Master reviews your application

The Senior Master will review all the information. They will decide whether to grant your application for payment out. This is a legal decision.

We will let you know of the Senior Master’s decision.

If the Senior Master grants your application, we will start the payment out process. We will let you know what you need to do.

If the Senior Master declines your application, we will explain the reasons to you. Nothing will change for you – we will still be here to help you apply to use your money.

In the future, if your circumstances change, you can talk to us about applying again.
